These Terms and Conditions ("Terms") govern all travel services, visa assistance services, airport assistance services, and related products provided by Vietnam CK Tour Operator ("VietnamCK", "we", "our", "us").
By booking any service, signing a travel contract, submitting an online application, or making any payment, you ("Customer", "you") confirm that you have read, understood, and agree to be legally bound by these Terms.
PART I – TRAVEL SERVICES
1. Formation of Contract
A binding contract is formed upon:
Signing a travel contract, or
Written confirmation of services by VietnamCK; or
Payment of a deposit or the full amount.
The person making the booking represents and warrants that they have the authority to accept these Terms on behalf of all persons included in the booking. All participants shall be jointly and severally liable for all obligations arising from the booking.
2. Prices and Payment Terms
Unless otherwise agreed in writing:
A deposit of 50–100% of the total price is payable upon confirmation.
The remaining balance must be paid no later than 30 days prior to the commencement of the first service.
Bookings made less than 30 days before commencement require full immediate payment.
Payment is considered received only when credited to VietnamCK’s designated bank account.
Failure to pay within the agreed deadline entitles VietnamCK to cancel the booking and apply cancellation fees under Article 6.
Exchange Rate Adjustment
VietnamCK reserves the right to adjust the agreed price up to 21 days before the start of services if exchange rate fluctuations used in the original calculation increase by more than 5%. Written notice will be provided.
3. Changes by VietnamCK Before Departure
If VietnamCK is compelled by operational, safety, or extraordinary circumstances to modify agreed services prior to commencement, VietnamCK may:
Offer alternative services of comparable quality; or
Adjust the price accordingly; or
Provide a refund if the change is substantial.
The Customer may accept the proposed modification or cancel the booking.
4. Changes During the Trip
If agreed services cannot be provided as contracted, VietnamCK shall use reasonable efforts to arrange substitute services of similar quality and scope.
If substitute services are of lower value, VietnamCK shall refund the price difference.
5. Changes Requested by the Customer
Changes are subject to availability and may incur additional costs.
Unused services due to voluntary early termination are non-refundable.
Name changes or replacement participants are permitted without administrative charge; however, third-party supplier fees may apply.
6. Cancellation by Customer
The Customer may cancel at any time before the commencement of the first service by written notice.
Cancellation fees are:
30% of the total price if cancelled 91+ days before the first service
35% if 90–61 days
40% if 60–51 days
50% if 50–41 days
75% if 40–30 days
100% if 29 days or less
The minimum cancellation fee shall not be less than any non-refundable supplier costs already incurred.
Failure to appear (“no-show”) constitutes cancellation with 100% charge.
7. Cancellation by VietnamCK
VietnamCK may cancel prior to commencement if:
Performance is prevented by unavoidable and extraordinary circumstances beyond reasonable control; or
The Customer materially breaches contractual obligations, including non-payment.
In such cases, refunds shall be limited to recoverable amounts after deduction of non-refundable supplier costs.
8. Force Majeure
VietnamCK shall not be liable for failure or delay caused by events beyond reasonable control, including but not limited to:
Natural disasters
Extreme weather conditions
War or civil unrest
Epidemics or pandemics
Government actions or travel restrictions
Airline disruptions or strikes
Refunds, if applicable, shall exclude demonstrable non-refundable third-party costs.
9. Customer Responsibilities
The Customer is responsible for:
Providing complete and accurate personal information
Holding a passport valid for at least 6 months beyond the arrival date
Obtaining required visas and entry permits
Verifying travel documents upon receipt
Arriving on time at designated meeting points
Acting responsibly and not causing damage or disruption
The Customer bears full responsibility for compliance with entry requirements.
10. Insurance
Travel insurance is not included unless explicitly stated in writing. VietnamCK strongly recommends comprehensive travel insurance covering medical expenses, cancellation, and travel disruption.
11. Complaints
Complaints must be submitted in writing without undue delay and no later than 30 days after completion of services.
VietnamCK will respond within 30 days of receipt.
PART II – AIRPORT FAST TRACK SERVICE
12. Nature of Service
Fast Track is an airport assistance service designed to facilitate expedited immigration procedures. It does not constitute or guarantee legal entry into Vietnam.
13. Non-Refundable Policy
Once confirmed, Fast Track service is strictly 100% non-refundable due to pre-arranged operational coordination with airport personnel.
14. Customer Data Accuracy
Customers must provide accurate flight details. Failure to notify of flight changes at least 24 hours prior to arrival may result in loss of service without refund.
15. No-Show Policy
Failure to contact VietnamCK’s hotline before leaving the airport premises shall constitute no-show and service shall be deemed rendered without refund.
16. Limitation of Responsibility
VietnamCK is not responsible for immigration decisions. Denial of entry by authorities does not entitle the Customer to any refund.
PART III – VISA & EVISA ASSISTANCE SERVICES
17. Scope of Service
VietnamCK provides administrative assistance in preparing and submitting visa applications. Final approval or rejection rests solely with the competent immigration authorities.
Visa issuance is never guaranteed.
18. Non-Refundable Fees
All visa service fees, including urgent and expedited services, are strictly non-refundable once the application has been submitted to the authorities.
Cancellation may only be possible within 5–10 minutes of submission before processing begins.
19. Service Completion
Visa service is deemed completed when the approval letter or confirmation is sent to the email address provided by the Customer.
VietnamCK is not responsible for:
Incorrect email addresses
Spam filtering
Customer failure to check the inbox
If no notification is received within 5 days, service is considered accepted and completed.
Approval letters cannot be amended once issued.
20. Visa on Arrival
Visa on Arrival applies exclusively to entry by air. Entry via land or sea borders invalidates eligibility, and no refund shall be granted.
PART IV – LIMITATION OF LIABILITY
21. Liability Cap
To the maximum extent permitted by applicable law, VietnamCK’s total aggregate liability shall not exceed the amount paid by the Customer for the specific service giving rise to the claim.
22. Exclusion of Indirect Damages
VietnamCK shall not be liable for:
Loss of profit
Loss of business opportunity
Flight changes or cancellations
Hotel cancellations
Consequential or indirect damages
including cases involving visa refusal or immigration denial.
23. Chargebacks and Payment Disputes
Initiating a chargeback without first attempting written dispute resolution with VietnamCK constitutes breach of contract.
VietnamCK reserves the right to submit full documentation to financial institutions and pursue recovery of administrative costs and damages.
PART V – GOVERNING LAW & JURISDICTION
24. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Socialist Republic of Vietnam.
25. Jurisdiction
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Ho Chi Minh City, Vietnam.
PART VI – WEBSITE USE
26. Acceptable Use
Users agree not to use the website for unlawful purposes, not to interfere with its functionality, and not to attempt unauthorised access.
27. Amendments
VietnamCK reserves the right to amend these Terms at any time. Updated versions become effective upon publication on the official website.
Continued use of services constitutes acceptance of the updated Terms.
